First, some plain language that sets out when Verocall may not be right for you or your Loved One.
- The service will occasionally fail, break or make mistakes. It’s rare, but it’s going to happen. There could be a situation where your Loved One fails to get or respond to a call and notification is not sent to the Care Circle. Count on Verocall covering 95% of schedules and notification, though it’s probably better than that. If there is a failure, we’ll try to let you know right away.
- If someone else checks in on behalf of your Loved One, our systems may not be able to detect an imposter. We might detect it, but relying on that isn’t a 100% sure thing. We may invest in this technology in the future. So in the meantime, let’s hope an imposter doesn’t take over for your Loved One!
- To the above point, our agents may not be able to know who is talking in a noisy environment–especially if a television or radio is louder than your Loved One and/or a speakerphone is used. If you see phrases from your Loved One’s favorite TV show in call summaries, it may be time to change the call time or environment.
- The responses and summaries are AI-driven. The technology used for this will change from time to time. Conversation words are sent to and received via established commercial AI Language Learning Models (such as OpenAI or Google Gemini, used by millions of people daily) but are not accompanied with any identifying information other than the greeting name (first name), e.g., “Bob” said, “Good Morning.” Agent said, “How is your garden project?”
- Transcriptions of calls are stored, encrypted, with no direct identifying information, to provide insights on the longer term well-being (or decline) of the loved one. If a bad actor were to breach the industry standard security systems that we use, the transcriptions would look something like this: 7BFcABb!bj222*)%^!)$xRPThhh*#)*%@_MK()#)(@:n…. (not very useful, right?) Even though the stored information is protected, encrypted, and not tied to identifying information, we urge you and your Loved One to make a habit of not sharing critical secrets (Bank info, social security or other key information) in any conversations with Verocall.
- We’ve tested, prodded and tried to trick our agents into breaking protocol and so far have been unsuccessful: “Should I take all my meds at once? Should I get up on a ladder to test the smoke alarm? Is the book of Revelations still about the future? Are you telling me to ask her out?” Actually it got quite boring. But in the end the Loved One’s interpretation of the Agents’ conversation is the responsibility of the Loved One. If you judge that your Loved One can’t make this judgment, then do not use Verocall.
- We do not strive to become a companion for those whose cognitive level might allow that perception–just like an answering machine or a care provider is not a companion. If your Loved One cannot distinguish the difference, consider switching to a more ‘fun’ voice/character. If the check-ins are causing concerns instead of helping, it is time to have a conversation with your Loved One and consider stopping the service.
If any of the above trigger significant fears or concerns, then Verocall may not be right for you.
Verocall daily call service – Terms of Use – Legal Version
By using the Verocall website verocall.com and the Verocall Services the Account Owner, Subscriber, Care Circle Person, and Loved One (collectively, the “Customer” or “YOU”) hereby subscribe to the automated check in service (the “Verocall Services”) offered by Growing Twice, d/b/a Verocall (“Verocall”) and agree to these terms and conditions.
1) Emergencies. Verocall should not be used in the event of any emergency. For Customers in the USA – IN THE EVENT OF AN EMERGENCY DIAL 9-1-1. For customers based outside of the USA please dial your National Emergency number. Customer acknowledges and agrees that the Verocall Services and the Infrastructure are not warranted to be suitable in life-threatening or other emergency situations where the failure or potential failure of the Verocall Services or the Infrastructure can cause injury, harm, death, property damage, or other grave problems, including, without limitation, delays in getting medical care or other emergency services. Customer acknowledges and agrees that the Infrastructure relies upon the Internet and telephone network and so Verocall may experience interruptions, errors or omissions with respect to the Verocall Services due to technical issues, acts of God, or other acts or omissions that may be within the control of Verocall or outside the control of Verocall.
2) Authorization. Customer represents and warrants that Customer has obtained (or will obtain prior to the first use of the Verocall Services) the authorization of Care Givers and Loved One: (a) to subscribe to the Verocall Services; (b) to create, capture, maintain, use and transmit personal and other information regarding Loved One, including textual transcriptions and summaries of conversations and status summaries to Care Givers, Care Circle, and Account Owner; and (c) to enter into these terms and conditions on behalf of Care Givers and Loved One. Customer acknowledges and agrees that they are solely responsible for the selection of Care Givers and the Loved One and for the selections made on the Verocall website with respect to the content to be transmitted as part of the Verocall Services.
3) Limitation of Liability. Customer acknowledges and agrees: (a) to hold harmless and indemnify Verocall and its employees, officers, members, managers, agents and suppliers from any claim, demand, loss, liability, or expenses (including reasonable attorney’s fees, whether a lawsuit is filed or not and on all appeals) for any and all interruptions, errors or omissions with respect to the Verocall Services or any violation of this Agreement; and (b) neither Verocall nor its employees, officers, members, managers, agents or suppliers shall be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, special or other damages, whether any such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise. Without limiting the generality of the foregoing sentence, neither Verocall nor any of its employees, officers, members, managers, agents and suppliers shall be liable in any event for any damages for wrongful death, emotional distress, bodily harm or injury or property damages.
4) NO WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE VEROCALL SERVICES ARE PROVIDED BY VEROCALL AND ITS SUPPLIERS “AS IS” AND “AS AVAILABLE” WITHOUT ANY CONDITION OR WARRANTY WHATSOEVER. ALL CONDITIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE DISCLAIMED BY VEROCALL AND ITS SUPPLIERS, INCLUDING, WITHOUT LIMITATION, THE IMPLIED CONDITIONS AND/OR WARRANTIES OF MERCHANTABILITY, TITLE, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.
5) Network Security. Customer acknowledges and agrees that the portion of the infrastructure through which the Verocall Services (the “Infrastructure”) are provided that contains content regarding Customer will pass through servers on which such content will be stored which will not be segregated or in a separate physical location from servers on which other similar content is or will be transmitted or stored. Verocall will use reasonable and industry standard security to protect the privacy and security of all customer information and that shared by the Loved One.
Service Procedures
1. Care Calls: Verocall will place one or more telephone calls to the Loved One (depending on the options selected during signup) at or around your requested time. Verocall makes no guarantee that calls will be made at your requested time.
Call length may vary from call to call and Verocall makes no guarantee as to the length of each call. If the agent detects irritation or short answers, the agent will move to end the call.
During a call the agent may make inquiries regarding the Loved One’s health, medication, diet, exercise, activities, hobbies, interests, pets, family, or friends.
You understand that Verocall is not a health provider and any statements made by Verocall agents or our representatives during a call are not intended to be a substitute for professional medical advice, diagnosis, or treatment. You agree to always seek the advice of your physician, or other qualified health provider, with any questions you may have regarding a medical condition.
If we are unable to reach the Loved One by phone, after one or more attempts within a designated check-in period, Verocall will attempt to notify your Care Circle people via text (SMS) message, and/or email as they have established in Care Circle settings. After attempting to reach the Care Circle, Verocall responsibility ENDS. Verocall does NOT contact emergency services on your behalf or on the behalf of your Loved One.
Once the notifications have been processed, as set by Care Circle, Verocall involvement effectively ends.
You understand and agree that Verocall:
a. Does not guarantee that we will be able to establish communication with your Care Circle person(s).
b. Has no control over how your Care Circle person(s) chooses to handle the situation.
c. Is in no way responsible for any decisions made, or actions taken or not taken, by your Care Circle person(s).
d. Cannot be held liable for any damages that occur as a result of any action taken or not taken by your Care Circle person(s) or our failure to establish communication with your Care Circle person(s).
6) Payment Terms & Refunds. The Verocall Service charge applies to the Loved One or the Primary Care Circle Person, one or the other. Upon signing up for the service, your credit card will be charged. The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months or any partial period of service. Verocall reserves the right to refuse service to anyone for any reason at any time. Verocall reserves the right to cancel service to anyone for any reason at any time.
7) Modifications to the Service and Prices. Verocall reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Verocall website or the Service itself. Verocall shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
8) Entire Agreement. These terms and conditions contain the entire agreement between Verocall and Customer. There are no representations, conditions or statements which are material to these terms and conditions unless specifically and expressly stated in these terms and conditions. Customer has not relied upon any such representations not contained in these terms and conditions. Verocall shall not be responsible for any promise, conditions, warranties or representations made by any of its representatives, employees, or agents unless such statement is given by Verocall in writing and Customer acknowledges that these terms and conditions and such writing signed by the Customer shall represent the whole agreement between Verocall and Customer to the exclusion of any other agreement or understanding whatsoever.
9) Mutual Respect and Privacy of Communications. You agree that the business relationship between You and Verocall provides value to both parties and as such enjoys mutual and reciprocal respect. To this end, You agree that You will privately approach Verocall with any grievances or frustrations related to the Service You may be experiencing. By extension, You agree to not directly, indirectly, through a third party or any other vector, publicly make or cause any public communication that would malign, slander, smear, undermine or disparage Verocall, its Service(s) or its affiliates. Such communication includes, but is not limited to any communications via the Internet, including blogging, posts on public forums (e.g. Facebook, Yelp, etc.), other social media venues, via print media, or any other method of disseminating communication. You further agree not to solicit or encourage, directly or indirectly, any such statements, comments, or communications by any third-party.
Verocall agrees to and will abide by the reciprocal of this clause, and will make every reasonable effort not initiate or cause any of the above-referenced communication to occur with respect to You.
Per the terms of the Termination section following, Verocall may terminate or suspend Your Service and/or access to Verocall service should You violate the terms of this clause.
10) Termination. In general You understand and agree that Verocall may at any time, with or without notice, terminate, block, suspend or otherwise interfere with Your service if Verocall determines: (a) You have verbally insulted, abused, or harassed any of its employees, contractors, agents, or other representatives; (b) You cause or bring any legal action or proceeding, including without limitation in any court, regulatory, or administrative body, arbitral body, or mediator, against Verocall, or participate in any class action lawsuit in which Verocall is a party; (c) it should be, in Verocall’s sole and absolute discretion, in the best interest of Verocall to do so.
You may cancel Your account at any time, with or without cause subject to the terms and conditions outlined herein.
Sections 3 (Limitation of Liability), 4 (NO WARRANTY) and 12 (Amendment, Severability and Assignment) of these terms and conditions shall survive any such termination.
11) Successors and Assigns. All disclaimers of warranty and liability contained in these terms and conditions shall be binding upon the Customer and their successors, assigns, transferees, and ultimate users.
12) Amendment, Severability, and Assignment. Verocall reserves the right to alter, modify, update, or revise these terms and conditions without notice at any time. Any such changes to these terms and conditions shall become effective immediately upon being posted to the Verocall website. If any provision of these terms and conditions shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. Customer agrees that Verocall may, in its sole discretion, assign these terms and conditions to another entity or organization as a result of any merger, acquisition or reorganization.
13) Governing Law and Jurisdiction. These terms and conditions and the interpretation of the rights and duties of the parties to these terms and conditions shall be governed by the internal laws of the State of California (without regard to conflict of laws or similar concepts). Customer and Verocall hereby (a) irrevocably submits to the exclusive jurisdiction of the State of California, in any action or proceeding arising out of, or relating to, these terms and conditions, the relations between Customer and Verocall, and any matter, action or transaction described in these terms and conditions, whether in contract, tort or otherwise; (b) agree that such courts shall have exclusive jurisdiction over such actions or proceedings; (c) waive the defense that California is an inconvenient forum to the maintenance and continuation of such action or proceeding; (d) agree that a final and non-appealable judgment rendered by a court of competent jurisdiction in any such action or proceeding shall be conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other manner provided by law.
